Fire Risk Assessment - The Legal Requirements

Here at Health and Safety North East, we don’t just provide training courses, we also advise businesses on their responsibilities according to law.

The key legislation all businesses should be aware of, is the Regulatory Reform (Fire Safety) Order 2005. It applies in all workplaces, excluding home offices, offshore workplaces, and work in the field, in the air or down a borehole.

The Order states that the 'Responsible Person' must undertake a Fire Risk Assessment. Additionally if an organisation employs five or more people, the findings of this assessment must be recorded, as evidence of completion.

A Responsible Person is defined by legislation almost always being the employer. However, if a building is shared with other organisations, the responsibility may be shared amongst several people.

Fire Risk Assessment - Prevention Is Better Than Cure

A major fire is difficult thing for any business recover from - over 70% of businesses suffering major fires, don't reopen or fail within three years.

Prevention is better than cure, and including the results of your Fire Risk Assessment into your Disaster Recovery Plans and Business Continuity Planning, makes good business sense.

Fire Risk Assessment - Fire Management Plan

Each business must also maintain a fire Management Plan, which includes:

  • Maintenance of records, including details of fire training and instruction provided, as well as, details of fire drills carried out, with the date, evacuation time and any problems encountered.
  • Maintenance and testing of fire equipment, including fire doors, signage and fire-fighting equipment, with the results recorded.
  • Regular reviews and updates of the Fire Risk Assessment by the ‘Responsible Person’.
